Implementation of Khmer New Year Days in 2024

On 8 April 2024, the Ministry of Labor and Vocational Training (“MLVT”) issued a Notification No. 009.24 on Implementation of Khmer New Year Days in 2024 (“Notification”).

According to the Notification, the MLVT has notified owners-directors of enterprises-establishments to allow all workers-employees to take paid leaves during Khmer New Year for four consecutive days starting from 13 to 16 April 2024.

However, paid leaves of workers-employees during Khmer New Year Days may be implemented differently from the Prakas 014.24 on Paid Public Holidays if there are agreements between workers-employees and employer, internal work rules, or collective bargaining agreements.

Besides, rotational paid leave on Khmer New Year Days is implemented for enterprises-establishments which have global business objectives, are required to operate daily, and are unable to pause the activities, and allowing all workers-employees to take leaves simultaneously can affect the public interests or operations of enterprises-establishments.

In case the rotational paid leave still does not work for operation of the enterprises-establishments, employers and workers-employees’ representatives shall discuss and agree with each other to work on Khmer New Year Days and take paid leave on other days instead.

List of workers-employees taking rotational paid leaves shall be prepared for inspection.
